BandGallery.com is a sharing and networking service which admits members and users to interact and socialize in the world of photography. The use of our site or any service that BandGallery.com provides is subject to these Terms of Use. You hereby agree to the Terms of Service, provided below, and recognize that these Terms can be officially updated by BandGallery.com from time to time. You should be aware of these Terms and changes, and should check them periodically. When finished reading this agreement, your acceptance is required to complete the registration process.

Purpose and Identification of Services

BandGallery.com provides a unique service which allowing a user to create a personal profile and host thirty images for personal, electronic publishing, blog systems, journals, message boards and networking/sharing use. User sign up’s are free without charge. Only one registration per person is permitted.
Photographers nation wide have the ability to register for additional fee to host their portfolios containing an unlimited amount of images. Registrars are solely responsible for all fees, and expenses by the use of services. BandGallery.com is not responsible for any interruption of user services caused by maintenance or technical difficulties. BandGallery.com offers private messaging and forum usage provided by PHPBB2.

Eligibility, Limitations, and Age requirements to join

Users of these Terms must be at least the age of Thirteen years.

Users are limited to one registration per person. Children under the age of thirteen are not permitted to registration on BandGallery.com. If it is noticed that any person with information or content showing that they are under the applicable age, BandGallery.com reserves the right to delete, ban, or erase that information for the website with or without notification.
Users are limited to the file size of the images they wish to upload based upon their account level. Users at any time may contact BandGallery.com to raise the level of their account. Any registered user, who fails to update their account in any period of 90 days or longer has the possiblitiy of losing their account. You will be notified of this action, if it ever should occur. Your accounts password is secure through BandGallery.com. It is solely the user’s responsibility to update their password.

Free User Registration Restrictions on the use of Services.

Under any/all circumstances you may not:

1. Use the Services for illegal purposes;

2. Upload or transmit any images that include or contain hidden or mysterious code such as music files, viruses or anything unrelated to the original structure of that image;

3. Upload or transfer files or content in which you do not have lawful rights to transfer;

4. Transfer, upload, post, or e-mail any unauthorized or unsolicited advertising, junk-mail, promotional campaign material, spam, or any other form of solicitation;

5. Input any material into your personal profile or messaging center that contains hateful, defamatory, harmful, threatening, unlawful material, nudity, child erotica, or anything that is considered to be objectionable to the creators of BandGallery.com;

6. You may not allow your profile to include the following items: your street address, last name, telephone number, names of relatives, social security number, or anything that you do not wish to be viewable to the general public;

Paid Registration Restrictions on the use of Services

Under any/all circumstances you may not:

1. Upload any photograph that is not your own or of which you have not been allowed to take;

2. Decline an e-mail or message of which you are asked to remove an image from your profile. You are required to contact BandGallery.com if there is miscommunication or a problem;

3. Use any of your uploaded images in any case of law, or judgment;

4. Upload or transfer files or content in which you do not have lawful rights to transfer;

5. Upload or transmit any images that include or contain hidden or mysterious code such as music files, viruses or anything unrelated to the original structure of that image;

6. Upload any images or photographs that contain crowd shots which display violence, or rough physical contact. Moshing/Dance is acceptable without viewable physical contact;

7. Download photographers photos or personal photos to distribute or use in any manner. Any use of a photograph without the permission of the photographer is a violation of copyright law;

Under any/all circumstances you must:

1. Understand that you as a photographer retain all rights and ownership of your work. All photographs uploaded are the sole property of the photographer, and the photographer retains all rights throughout the world to their photographs

2. Registrars and photographers are only permitted to post photographs for which they are the sole owner and copyright holder.

3. Understand that if any photo is removed from your account at any time with or without notification that is solely for reasons in which do not abide by these Terms;

4. Follow all Free User Agreements. (Uploading restrictions and content restrictions);

5. Understand that your payment of registration at BandGallery.com starts the day payment is received;

6. Acknowledge that there is an upfront payment of at least 12 months, the price stated in our records is the price accepted to pay, and that the price can be changed and or updated at any time to BandGallery.com’s discretion;

7. Understand that BandGallery.com assumes no responsibility or liability for any material posted on your profile. BandGallery.com reserves the right to reject, refuse, decline or delete anything that goes against the Terms. We reserve the right to suspend, ban, or terminate your access to your account with, or without notification;

8. Understand that the owners of the club or venue in which the photography was taken has the right to contact you or BandGallery.com and at their own discretion to remove that image;

9. Understand that BandGallery.com highly suugests the use of a trademark/copywrite/watermark on all of your photos, and that BandGallery.com is not responsible if your photos are used by any other organization without this watermark.

Copyright Infringement

BandGallery.com respects the rights of others and their copyrighted material, trademarks, and other proprietary information. You understand by posting and uploading your images and photography to BandGallery.com, that BandGallery.com is not to be held liable for the unauthorized copying, recreation, alteration, or dissemination of your images. BandGallery.com is not to be held liable or responsible if any of these actions occur. You may not post, distribute, alter, or reproduce in any way any copyrighted material, trademarks, or other proprietary information without the consent of the original owner of the material and the rights. It is through BandGallery.com’s policy to delete or terminate a member's account if any of copyright material is repeatedly infringed.

User, Registrar Disputes

All members and registrars are solely responsible for their interactions with other members. BandGallery.com has the right, but no obligations, to monitor these actions and or disputes between the members.

Indemnification

You hereby agree to indemnify and defend BandGallery.com and all of our staff members, affiliates and partners harmless from and against any and all losses, liability, costs, and expenses (including attorney’s fess) incurred by any BandGallery.com staff in connection to violations of rights of publicity or privacy, copyright infringement or trademark infringement.

Disclaimers

BandGallery.com disclaims any and all responsibility to deliver any information or material that has been deleted. BandGallery.com disclaims the responsibility of results between any two party’s disputes of images, hosting, and profile content.
BandGallery.com also disclaims any and all responsibility or liability for any harm resulting from downloading or receiving information and materials from the site.

AGREEMENT

You the user hereby understand and agree that any material you download or is obtained through this service is done at your own discretion and risk. You are solely responsible for any damages to your computer system or loss of data that may occur while downloading and or uploading material.

These Terms of Service comprise an agreement between you, the user, and Band Gallery.com accounting to the matters contained, and overhears any other agreements, written or oral, between BandGallery.com and yourself.
This agreement is accepted upon your use of BandGallery.com and is affirmed by you becoming a registrar of our Service. The failure to exercise any of these Terms and agreements shall not operate as a waiver or enforce any right or provision.
